Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Stayaway desktop application, website, and related services (together, the "Service"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

Stayaway is operated by an individual, Mehar Sulaiman ("we", "us"), based in Pakistan. You can reach us at support@stayaway.app.

2. What Stayaway does

Stayaway simulates light, human-like local activity — such as small mouse movements, scrolling, and safe keyboard input — so that a computer you are using does not register as idle while you read, think, present, or step away briefly. It runs on your own device under your control.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own use, subject to these Terms and the plan you have chosen (Free, Pro, or Lifetime). You may not resell, redistribute, sublicense, or reverse-engineer the Service except where permitted by applicable law or an applicable open-source license.

4. Acceptable use and your responsibilities

Stayaway is a tool for focus, breaks, and personal autonomy. You are responsible for how you use it. In particular:

• You must comply with your own obligations. You are solely responsible for complying with any employer policies, contracts, terms of service, or laws that apply to you. We do not advise you on whether using the Service is permitted in your situation.
• No fraud or illegal use. You may not use the Service to commit fraud, to deceive a party to whom you owe a legal or contractual duty, or for any unlawful purpose.
• No misuse of the Service. You may not interfere with, attack, or attempt to gain unauthorized access to the Service or its infrastructure.

5. Accounts

Some features require an account. You agree to provide accurate information and to keep your credentials secure. You are responsible for activity under your account.

6. Plans, billing, and payments

Stayaway offers a Free tier, a Pro subscription, and a one-time Lifetime license. Payments are processed by Lemon Squeezy, our Merchant of Record, who handles billing, taxes, and card data — we never see or store your full card details. Prices may change; we will give notice of changes before they affect you. Refunds are described in our Refund Policy.

7. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that it will be undetectable by any particular monitoring software. You use the Service at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, income, or employment, arising out of or related to your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the twelve months before the claim.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully.

10. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, provide reasonable notice. Continued use after changes means you accept them.

11. Governing law

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Courts located in Pakistan will have jurisdiction, except where applicable law gives you the right to bring proceedings elsewhere.
